These Terms of Service ("Terms") govern your access to and use of the Hop & Barrel website and application ("Service") operated by Hop & Barrel ("we," "us," or "our") at hopandbarrel.com. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Hop & Barrel is an AI-powered marketing planning tool designed for craft brewery owners, taproom managers, and brewery marketing professionals. The Service uses artificial intelligence to generate marketing calendars, social media content, operations timelines, and print and email materials tailored to your brewery.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will give reasonable advance notice of material changes where practicable.
You must be at least 18 years of age and have the legal authority to enter into contracts to use the Service. By using Hop & Barrel, you represent that you meet these requirements.

You may not share your account with others or create accounts on behalf of third parties without our written consent. Each subscription is for a single brewery operation.
Access to Hop & Barrel requires a paid monthly subscription. Subscriptions are processed through Stripe, our third-party payment processor.
Free trial: We offer a 3-day free trial for new subscribers. No charge is made during the trial period. At the end of the trial, your subscription automatically converts to a paid monthly plan unless you cancel before the trial ends.
Billing: Your subscription renews automatically each month on the anniversary of your signup date. By subscribing, you authorize us to charge your payment method on a recurring monthly basis until you cancel.
Price changes: We may change subscription pricing with at least 30 days' written notice to your account email. Continued use of the Service after a price change takes effect constitutes acceptance of the new price.
Refunds: We do not offer refunds for partial months of service. If you cancel your subscription, you retain access through the end of your current billing period. We may issue refunds at our sole discretion in cases of documented technical failure on our part that prevented access to the Service for an extended period.
Failed payments: If a payment fails, we will notify you by email and attempt to process the payment again. If payment remains unsuccessful after reasonable attempts, your access to the Service may be suspended until payment is resolved.
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period โ you will not be charged again after cancellation, and you retain full access through the period you have already paid for.

Upon cancellation, your account credentials will be deactivated and AI generation features will no longer be accessible. Any plan files you have previously saved to your device remain yours to keep.
The marketing plans, social media posts, campaign calendars, and other content generated through the Service ("Your Content") belong to you. We claim no ownership over the outputs you generate using Hop & Barrel.
By using the Service, you grant us a limited, non-exclusive license to process the information you enter solely for the purpose of providing the Service to you โ specifically, to forward your inputs to Anthropic's API to generate AI responses. We do not use your content to train AI models, sell it to third parties, or use it for any purpose beyond operating the Service.
You are responsible for the accuracy of the information you provide and the appropriateness of the content you generate. You represent that your use of generated content complies with all applicable laws, regulations, and third-party rights.
The Service uses Anthropic's Claude AI to generate marketing content. You acknowledge and agree that:
We recommend reviewing all generated content before publishing or distributing it. The brewery-specific nature of our prompts produces better results than general-purpose tools, but no AI system produces perfect output 100% of the time.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not use the Service to:
We reserve the right to suspend or terminate accounts that violate these restrictions without refund.
The Hop & Barrel name, logo, website design, application interface, and underlying software are our property and are protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our proprietary materials without written permission.
The AI-generated content output of the Service โ your marketing plans, social posts, and other materials โ is yours to use freely in your brewery business.
The Service integrates with or relies on third-party services including:
We are not responsible for the terms, availability, or actions of these third-party services. Your use of integrated third-party services is subject to their respective terms.
To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee any specific business results from use of the Service. Marketing outcomes depend on many factors outside our control, including your market, execution, and broader business conditions.
To the fullest extent permitted by applicable law, Hop & Barrel and its owners, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost revenue, lost data, or business interruption, arising from your use of or inability to use the Service.
Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid to us in the three months preceding the event giving rise to the claim.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
You agree to indemnify, defend, and hold harmless Hop & Barrel and its owners, employees, and contractors from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you create or publish using the Service.
Either party may terminate the service relationship at any time. You may cancel your subscription as described in Section 4. We may terminate or suspend your access to the Service immediately, without prior notice or liability, if:
Upon termination, your right to use the Service ceases immediately. Sections 5, 8, 10, 11, 12, and 14 survive termination.
These Terms are governed by the laws of the United States and the state in which Hop & Barrel is based, without regard to conflict of law principles.
Before initiating any formal dispute, you agree to contact us at legal@hopandbarrel.com to attempt to resolve the issue informally. We will make good-faith efforts to resolve disputes within 30 days of written notice.
Any dispute that cannot be resolved informally shall be resolved through binding arbitration under the rules of the American Arbitration Association, conducted in English. You waive any right to participate in a class action lawsuit or class-wide arbitration against us.
We may update these Terms from time to time. When we make material changes, we will notify you by email at least 14 days before the changes take effect. Your continued use of the Service after the effective date of updated Terms constitutes acceptance of the changes.
If you do not agree to updated Terms, you must cancel your subscription before the effective date of the changes.
Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hop & Barrel regarding the Service and supersede all prior agreements.
Severability: If any provision of these Terms is found unenforceable, the remaining provisions continue in full force and effect.
No waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future.
Assignment: You may not assign your rights under these Terms without our written consent. We may assign our rights and obligations freely.
